Compliance strategy guidance

Obtaining an EPA Establishment Number

Pesticide products and devices generally require an EPA establishment number. Although pesticidal devices are not subject to premarket registration, they must be produced in an EPA-registered establishment, and the establishment number must appear on the device or its label. Our experts can assist in creating a Pesticide Submission Portal (PSP) account in the CDX system, applying for an Organization ID, Company Number, Section Seven Tracking System (SSTS) account and Establishment Number, establishing an Electronic Signature Agreement, and initial reporting.

Preparing the EPA submission package

An EPA submission package contains all necessary scientific data and supporting documents. Our experts can review your existing data against the requirements for your submission type, identify data gaps, and assemble the final submission package.

Data compensation and citation strategy

Much of what makes a US pesticide registration affordable is deciding what you cite rather than what you generate. FIFRA lets applicants rely on data submitted by others, subject to compensation obligations. We can provide advice on where citing existing data is available to you and where original studies are unavoidable, to create a cost-effective data strategy.

Annual EPA registration maintenance

State and Territory level registration

Under FIFRA, states and territories may impose additional requirements governing the sale and use of federally registered pesticides. Generally, pesticide products registered at the federal level must also be registered in each state or territory where they are marketed or sold. State and territorial requirements vary and may include additional data, fees, labeling, licensing, or other requirements. Our experts can assist with the registration and ongoing maintenance of pesticide products at the state and territorial levels.

Notice of Arrival of Pesticides and Devices (NOA)

A Notice of Arrival (NOA) is generally required when importing pesticides or pesticidal devices into the United States. Under FIFRA and the implementing regulations, importers or their agents must submit the required NOA information to EPA prior to the arrival of the shipment in the United States. Our experts can provide guidance on satisfying applicable NOA requirements.
